Selling Property As-Is

All properties in California are sold "as-is" (CA-RPA Section 7B(1)). Some listing agents think that by putting that language in a counter-offer it prevents the buyers from trying to negotiate repairs. This is not the case. 

Even when listing agents counter that a property is being sold "as-is", as long as your client still has an inspection contingency, they retain the right to conduct inspections and then request repairs and/or credits or back out of deal if they desire. 

Neither an "as is" sale nor the buyer's independent inspection exonerates a seller or the seller's agent from fraudulent misrepresentations concerning known defects not otherwise visible or observable to the buyer.
