What is the AB 38 Fire Inspection?
AB 38 created three new requirements for sellers and buyers in many areas of the State - two disclosures and one point-of-sale requirement for inspection (and compliance documentation).
A new C.A.R. FHDS form was released the week of June 21, 2021.
- Disclosure 1: Begins January 1, 2021, Home Hardening Disclosure, reflected in the draft FHDS Form.
- Disclosure 2: Will begin July 1, 2025, Retrofits, will be reflected in a future C.A.R. Form
- Point-of-Sale Inspection & Documentation (POS): Beginning July 1, 2021, the seller of a property located in a High or Very High Fire Hazard Zone shall provide documentation to the buyer stating that the property is in compliance with laws pertaining to state law on defensible space (PRC 4291) OR local vegetation management ordinances, OR in certain cases the buyer and seller will agree that the buyer is to obtain the documentation after close, C.A.R. 2020 New Laws.
