Operating Under a Fictitious Business Name (FBN)

Question: If I own an LLC or corporation, can I run my real estate business under that LLC or corporation name or will I need to obtain a fictitious business name first?

An employing broker may authorize a real estate salesperson in their employ to file an application with the county clerk to obtain a fictitious business name under which the salesperson may conduct business. The salesperson filing for the fictitious business name is required to:

1. deliver to the California Department of Real Estate (CalDRE) an application signed by the broker requesting permission to use a county-approved fictitious business name identified with the broker’s license number;
2. pay any fees associated with filing an application with the county and/or CalDRE for a fictitious business name; and
maintain ownership of the fictitious business name subject to the control of the broker.
Note: The FBN must be filed in the county of the brokerage's main office, according to DRE regulations. Our main office is located in Ventura County.
